1. Agreement to These Terms
These Terms of Service govern access to and use of Truefluencers.com and its related marketplace, messaging, campaign coordination, and support services.
By accessing the website or creating an account, you agree to the terms applicable to your use. Additional Brand Terms, Influencer Terms, and campaign-specific agreements may apply.
If you do not agree to the applicable terms, do not use the relevant services.
2. About Truefluencers
Truefluencers operates a managed influencer collaboration marketplace.
Brands can discover and select creators, submit campaign briefs, and discuss proposed collaborations with the Truefluencers team.
Truefluencers coordinates communications, commercial discussions, contractual arrangements, campaign progress, and deliverables according to the agreements entered into by the relevant parties.
A creator's public listing, a brand's selection, or submission of a campaign brief does not by itself confirm a booking or guarantee that a campaign will proceed.
3. Eligibility and Accounts
You must provide accurate information and be legally capable of entering the agreements applicable to your activities.
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account, subject to applicable law.
You must promptly notify us of suspected unauthorised access.
We may request information reasonably necessary to verify account ownership, business identity, creator eligibility, or authority to act for a company.
4. Creator Approval
Creators may be required to satisfy eligibility, verification, portfolio, and professional standards established by Truefluencers.
Submitting an application does not guarantee approval, publication, or selection for a campaign.
Truefluencers may request additional information, reject incomplete or misleading applications, or restrict a profile in accordance with applicable policies and law.
5. Brand Accounts and Campaign Enquiries
Brands must provide accurate business and contact information and submit lawful, sufficiently clear campaign requirements.
Truefluencers may request clarification, decline unsuitable briefs, or request changes before proceeding.
A campaign becomes confirmed only when the necessary commercial terms, contractual agreements, creator acceptance, and other applicable prerequisites have been completed.
6. Managed Communications
Initial brand enquiries and campaign briefs are handled by the Truefluencers team.
Truefluencers coordinates communications with selected creators and relays relevant campaign information as necessary.
Users must not misrepresent another party's position, fabricate acceptance, or claim that a campaign is confirmed before the required approvals and agreements exist.
7. Fees, Payments, and Contracts
Campaign pricing, service fees, creator compensation, payment schedules, taxes, and other commercial terms will be specified in the applicable proposal, invoice, or signed agreement.
These general Terms do not establish a universal fee, payment deadline, refund entitlement, or escrow arrangement.
Do not assume that funds are held in escrow or that a payment has been made unless the relevant payment arrangement and transaction records confirm it.
The applicable signed campaign agreement takes precedence for campaign-specific commercial terms, subject to applicable law.
8. Content and Intellectual Property
Users retain ownership of content and intellectual property they own, except where rights are expressly granted or transferred under an applicable agreement.
Creators must have the rights and permissions necessary to provide campaign content. Brands must have the rights and permissions necessary for materials, trademarks, products, and instructions they supply.
Ownership, licensing, usage duration, territory, paid advertising rights, exclusivity, editing rights, attribution, and permitted reuse must be established in the applicable campaign agreement.
No broader rights are granted solely because content is uploaded to or displayed on the platform.
9. Acceptable Use
You must not:
- Submit false identities, fabricated metrics, or misleading campaign information.
- Impersonate another person or business.
- Upload unlawful, infringing, malicious, or unauthorised material.
- Misuse private contact details or confidential campaign information.
- Attempt to access accounts, messages, or files without permission.
- Manipulate reviews, ratings, social metrics, or verification processes.
- Use the platform for fraud, unlawful discrimination, or prohibited activities.
- Interfere with platform security or availability.
- Breach an applicable campaign agreement.
10. Reviews and Public Content
Any reviews or testimonials displayed on the platform must be handled in accordance with applicable policies and law.
Users must not submit fabricated reviews, impersonate customers, or manipulate ratings.
Truefluencers may moderate or remove content where reasonably necessary to address policy violations, legal requirements, or safety concerns.
11. Platform Availability
We aim to maintain reliable access but do not guarantee uninterrupted or error-free service.
Features may change, become temporarily unavailable, or be discontinued. We will take reasonable steps to protect active campaigns and communicate material service changes where appropriate.
12. Suspension and Termination
We may restrict or suspend access where reasonably necessary to address security risks, suspected fraud, serious policy violations, legal obligations, or risks to other users.
Where appropriate and lawful, we will provide an explanation and an opportunity to resolve the issue.
Account termination does not automatically cancel outstanding contractual obligations, payment duties, or lawful recordkeeping requirements.
13. Disputes
Users should first contact the Truefluencers team to attempt to resolve platform or campaign issues.
Campaign disputes are handled under the applicable signed agreement and relevant law. These Terms do not eliminate any non-waivable rights or remedies available under applicable law.
14. Limitation of Liability
To the extent permitted by applicable law, Truefluencers is not responsible for losses arising from circumstances beyond its reasonable control, inaccurate information supplied by users, independent third-party platform failures, or a user's breach of applicable agreements.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory legal rights.
Any additional limitation, indemnity, or liability cap must be established in a legally reviewed version appropriate to the business model and jurisdiction.
15. Changes to These Terms
We may update these Terms as our services or legal requirements change.
The current version will display its effective or revision date. Material changes will be communicated where required by applicable law or the relevant contract.
16. Governing Law and Contact
The governing law, dispute forum, and any jurisdiction-specific terms must be finalised by legal counsel based on the operating entity and intended markets.
